Is there a time limit for making an asbestosis compensation claim?

For all asbestos compensation claims there is a general rule which is known as the 3 year limitation period. This rules effectively means that you have 3 years in which to decide and issue proceedings regarding your claim for compensation. The date starts from the point when you first became aware that of your illness being caused by exposure to asbestos. If you fail to issue a claim within the 3 year period you may become statute barred and be unable to pursue a claim for compensation.

However, if you are a close relative who is considering bringing a claim for compensation on behalf of a family member who has recently passed away as a result of asbestosis or any other asbestos related disease, then the 3 year time limit commences on the date of the victim's death.
